Latest Opinion: Order precluding DNA Results
In U.S. v Johnston, the Court ruled DNA results inadmissible for three reasons: (1) the Government failed to demonstrate the reliability of the calculated Likelihood Ratios, given that the lab had not validated for relatives; (2) the Government failed to demonstrate the reliability of the Number of Contributor determinations in an analysis where NOC substantively mattered; and (3) the Government's evidence failed Rule 402 and 403 analysis given its limitations for understanding the questions of how and when.
