"More than 1,000 criminal cases across Texas may now have a question mark over them. The culprit? Faulty DNA tests. As Texas Public Radio's Paul Flahive reports, the tests were made by one of the biggest manufacturers in the world."

In U.S. v Johnston, the Court ruled DNA results inadmissible for three reasons: (1)  the Government failed to demonstrate the reliability of the calculated Likelihood Ratios, given that the lab had not validated for relatives; (2) the Government failed to demonstrate the reliability of the Number of Contributor determinations in an analysis where NOC substantively mattered; and (3) the Government's evidence failed Rule 402 and 403 analysis given its limitations for understanding the questions of how and when.
